How to Obtain a Tourist Rental License in Ibiza

If you want to invest in a property in Ibiza for tourism rental purposes, you must carefully carry out thorough research and plan. It is essential to take caution – as you will see, obtaining a tourist rental license is not easy. 

In 2012, a new law was passed, the ‘Ley de Arrendamientos Urbanos’, or LAU (Urban Leases Act). Under this law, short-term holiday rentals were allowed as long as you met the standard requirements. However, later in the summer of 2017, the law changed significantly and getting a permit got a lot tougher. Nowadays, many properties in Ibiza are not eligible for tourist rental licenses. 

To help you, we have created a short guide that provides all of the information you need to obtain a tourist rental license in Ibiza. However, seeking legal advice comes highly recommended as laws and regulations are constantly changing. Ensuring everything is correct and legal can save you hefty fines and unwanted situations.


Is my property eligible for a tourist rental license in Ibiza?

If you’re renting your place for less than a month, you need a tourist rental license. Ibiza’s tourist rental licenses tend to be for detached houses. However, it doesn’t mean all detached houses will get a tourist license. All requirements must be met, no matter what. 

If you want to buy an apartment to rent out for holidays, you should be aware that a tourist licence may not be accepted. Licenses were not previously allowed in shared buildings (therefore apartments), and even though this regulation has now changed and apartments are now theoretically permitted, in reality, they must first be approved by the local authorities’ board.


Ibiza has a set of minimum requirements that properties must meet to receive a tourist licence.  The following list outlines the main requirements, although there are other factors to consider related to any given property:

  1. There must be an occupancy certificate for the property, known as the ‘Cedula de Habitabilidad’.
  2. Residents’ quality of life is the primary concern. The property must be located within a "tourist zone". These zones are based on environmental data, population statistics, and planning criteria without compromising an area’s management capabilities or resources.
  3. When a previous sanction for a severe breach of a holiday rental licensing law exists, a home cannot be rented for vacations. Naturally, once the sanction is fulfilled and the property’s legality is restored, the property may again be considered for vacation rentals. Therefore, when looking for a tourist license, you should request a ‘certificado de inexistencia de infraccion urbanistica’’ to ensure no sanction exists.
  4. Before the house can obtain a touristic license, it must be at least five years old, and during those five years, it must have been used as a private residence.
  5. The property must also possess an energy certificate. Specifically, the construction of a house must meet the F rating for buildings constructed before 31/12/2007 and the D rating for buildings built after that date.

Rental licenses are now available for apartments, but only if the board of owners approves. Additionally:

  1. Licenses must be renewed every five years.
  2. Renters must be informed in writing about the house rules and must respect them.
  3. Renters who do not respect the regulations must vacate the property within 24 hours.
  4. Insurance must cover potential damage the clients may do to community property.
  5. The community must have a 24-hour service number.

How do I apply for a tourist rental license to rent my property in Ibiza?

To obtain a tourist license from the local council, applicants must submit the following documents: 

  1. A "responsible declaration" ("Declaración Responsable de Inicio de Actividad de comercialización de estancias Turísticas en viviendas") which meet the criteria for tourist rentals in Ibiza
  2. Plans and documents related to the property
  3. Ownership documentation
  4. The number of guest beds must not exceed the number of people legally allowed to occupy the property according to the certificate (cédula).
  5. The local council issued a certificate proving that the property is located in a holiday-letting area (tourist zone).
  6. Proof that the property meets the legal requirements for holiday rentals
  7. Once you have paid the application fee, you will receive a preliminary rental license number.

How long will I need to wait before I can start renting my property in Ibiza?

Upon submitting your tourist rental license application, you confirm that your property meets all the required criteria. Once you have applied, you will receive a preliminary rental license number and you can immediately begin renting out the property. An inspector will carry out all the relevant checks at a later date. After this, if there are any inaccuracies, omissions, or falsifications in the application statement, the registration will be cancelled, and holiday rental activity will be suspended immediately. Once a rental license number (whether preliminary or final) has been allocated, it must be used for advertising on portals like Airbnb so that guests and authorities can check whether a holiday rental is legal.

IMPORTANT DISCLAIMER: Since February 2022 there is a 4-year moratorium on the "creation of new tourist beds" which effectively means a hold on all applications of new rental licences in the Balearics. This means that while you are free to submit the paperwork and fees, they will not be processed for (at least) the next 4 years and no preliminary numbers will be issued. What happens if my new property or villa in Ibiza already has a rental license or application at the point of purchase?

Those who wish to purchase a property with a current tourist license need not worry about reapplying. However, you should still check everything thoroughly. Approved licenses will always have an ETV certificate (Estancia Turistica en Viviendas).

    Ibiza’s nightclub scene has already begun its opening season two weeks earlier than usual, with venues such as Ushuaia, Pacha, and being the first to kick-off following the IMS 2022 finale. Ibiza is set to have its longest clubbing season to date, which could extend as far as November. And, of course, this year’s line-ups are looking to be of an excellent standard too!

          Ibiza COVID-19 News 2022

          Updated – May 6, 2022

          We are pleased to announce that the use of masks related to COVID-19 is now only mandatory in the following cases:

          • In all health centres, services, and establishments, whether by workers, visitors, or patients, with the exception of those who remain in their private rooms.
          • On all means of public transportation, whether by air, bus, or boat, where it is impossible to maintain a distance of 1.5 metres, except in cabins when they are shared by a number of occupants.

          It is still recommended that those who have been exposed to COVID-19 continue to wear masks in situations where prolonged contact with persons less than 1.5 metres away will occur.

          Further, using masks responsibly in enclosed public spaces where people pass through or remain for extended periods, as well as during mass events. Family gatherings, private meetings, or celebrations, are also encouraged to take responsible action depending on the vulnerability of the participants.

          We’ve finally said goodbye to COVID-19 Full Vaccination Certificate (covid passport) and face masks in all outdoor areas including courtyards, terraces, and all educational facilities.

          All restrictions have been placed at a minimum, yet it is a requirement to follow the below four measurements:

          • Maintain a safe distance as much as possible
          • Wear a face mask (covering nose and mouth) in largely populated public indoor spaces when it is not possible to maintain a safe distance of 1.5m in overcrowded areas
          • Maintain personal hand hygiene 
          • Smoking remains prohibited on the terraces of establishments for public use or similar spaces

          In the case of hotels and restaurants, when indoors guests should always be seated and wearing a mask, except at the time of consumption. Hotel and catering employees must wear a mask at all times. 

          Within these establishments, 100% capacity is authorised with a minimum of 4 square metres per table to maintain the interpersonal safety distance and with hydroalcoholic gels and hand sanitisers available.

            The Ibiza Travel Forecast 2022

            For the first time in almost two years, 2022 is appearing to be the very best year to date for travel. Naturally, travel and tourism still involve advance planning and remaining patient and flexible, but as countries are easing restrictions, and vaccination passports, passenger locator forms, and health testing are becoming the new normal, the vast majority of travellers are finally feeling confident to plan and take their next vacation as normal. 

            Gratefully, there was a lot of unexpected optimism in the tourism industry here in Ibiza over the past two seasons, particularly in the luxury travel sector. Although we all hoped that the optimism would continue, recent "good news" from the media and the nightclub industry have given us every reason to expect the summer of 2022 to be an even better year for Ibiza, attracting tourists from across the globe and bringing things back to how they once were.

            

            Ibiza Night Clubs are Due to Open for their First Full Season this 2022

            In addition to the nightclubs announcing their opening this year, they have also planned to open two weeks earlier than usual, from the end of April, through until October, or possibly November if all goes well.

            As part of the island’s nightlife season, all major operators are working hard to get ready. With a possible 65% capacity, a valid COVID passport, differentiated zones to ease into things safely, and a few necessary restrictions, the clubs will hopefully be fully operational in early Spring. 

            So far, Amnesia has announced their opening party for 2022 and it has not taken long to revolutionise clubbers around the world, who are already placing their bets on the lineup of the opening. On May 21 Amnesia opens its doors and tickets are already on sale too.

            General COVID-19 Restrictions and Measurements in Ibiza

            Even though we can’t predict what the season ahead holds, Ibiza adapted well both during the summer of 2020 and 2021, maintaining a very positive attitude and safety throughout, where the majority of activities and many social events continued to operate as usual. It is evident from the past two seasons, even during much uncertainty, that tourism and events in 2022 will continue to increase and thrive on the island. 

            We have not only seen an increase in culinary experiences, including the opening of numerous new restaurants, especially in the Santa Eulalia area, but tourists have also taken a deeper interest in a multitude of outdoor activities such as sunset charters, private yachts, and the discovery of the island’s hidden gems! All of which has led to many tourism sectors having reported experiencing their best summer seasons, even when compared to prior to the pandemic. 

            Over the winter period 2021/22 we saw a brief tightening of restrictions, whereby proof of ‘COVID Vaccination Passports’ was required for entering restaurants and attending large-scale events. However, these restrictions eased after 2 weeks as the social Christmas season returned back to normal. Like many European countries, mandatory masks are still required in busy urbanised areas and when attending public places like supermarkets and indoor venues, something that will likely continue and is preferred for the safety of us all. 

            So right now, apart from the above-mentioned mask-wearing, there are NO Covid-related RESTRICTIONS in Ibiza.

            Travel to Ibiza Safely this Season 2022 – Entry Requirements to Enter Spain

            It is very important to stay up-to-date on both the requirements for entering Spain as well as the restrictions that may apply once you arrive in Spain.  

            In light of the fact that the Pandemic is constantly changing, here are a few links and information points to keep in mind.  You can take the majority of the stress out of your travel experience if you have a solid understanding of what to expect before you go and can effectively plan everything that you need. 

            

            Do I need a  Health Control or Passenger Locator Form to enter Ibiza?

            The safety of tourism is dependent on the health control measures taken. The Balearic Islands require that all visitors entering from other international countries, regardless of their nationality, age, or any other consideration, complete a health check or a passenger locator form. 

            It is important to note that the only travellers to whom this form does not apply to are international passengers in transit at a Spanish airport with a final destination in another country, provided that the transit lasts less than 24 hours and that the passengers do not leave the airport premises. It is imperative that each form is fully completed accurately on an individual basis in order to check-in and fly.             Do I need a Vaccination Certificate, Diagnostic Test or Recovery Certificate to enter Ibiza?

            All passengers arriving from another country must present one of the following documents in order to enter Spain:

            1. A certificate of Vaccination against COVID-19 

            Valid from 14 days after the complete vaccination schedule (x2) and for up to one year after the date of vaccination.

            1. A negative certification of an active infection diagnostic test

            Required 72h prior to arrival in the Balearic Islands or a rapid antigen test, 48h prior to arrival in the Balearic Islands. Currently, at the point of publishing this type of certificate is NOT accepted in the case of passengers arriving from the United Kingdom (UK).  A full Vaccination certificate is required.

            1. A certificate of recovery after having contracted the disease

            Corresponding to a test within a period not exceeding 180 days after the date of the first positive result of an active infection diagnostic test (NAAT) and no earlier than 11 days following the date of that positive result. Currently, at the point of publishing this type of certificate is NOT accepted in the case of passengers arriving from the United Kingdom (UK).  A full Vaccination certificate is required.

            These certificates (vaccination, diagnostic test, recovery) must be the original, written in either Spanish, English, French, or German, and may be presented in paper or electronic format.

            Tourists and residents of the Balearic Islands can take the rapid antigen test upon arrival without an appointment at the Balearic Islands Health Service’s COVID EXPRÉS testing centres.

              Prestige Properties Ibiza – It’s the Season of Giving Back

              Every year around Christmas, Prestige Properties supports a local charity. For 2021, we have chosen two charitable purposes: Ibiza Food Bank, which collects food for people in need, and Peacharoo, a caring heart who is raising funds to build a school for orphans in Uganda. 



              Ibiza Food Bank – Alleviating Poverty in Ibiza

              Undoubtedly living through a global pandemic, for the last two years, has been quite challenging for everybody. While some were able to rearrange their way of living and working, others have lost their jobs, homes, and loved family members. Particularly here in Ibiza, people have suffered immensely due to the pandemic, as it has had a dramatic impact on the island’s economy. While many were able to work during the summer months, when tourism is booming, many fall into unemployment in winter. 

              As plenty of Ibiza’s inhabitants lose their regular income in winter, they must live from what they’ve earned during the high season, hence finding themselves in a miserable situation, with little or no income, no savings, and in the worst cases, without food.

              For this reason, Ibiza Food Bank started their initiative, supporting those who cannot afford to buy food. Their volunteers collect food donations and cash donations across the island. The donated food is then sorted in Playa Den Bossa, stored, and distributed to their charity partners (The Red Cross, Caritas, Mother Teresa Food Bank in Jesus, Equip Voluntario, Food for Ibiza, and Doctors of the World). With their help, around 4000 people are being fed, weekly. 

              To maximise their time and donations, Ibiza Food Bank has partnered up with Carritos Solidarios, making sure to be able to provide enough food during the hard winter months. Together they place trollies at the entrance of around 70 supermarkets in Ibiza, which are accompanied by two volunteers in uniform, encouraging shoppers to leave dry food donations and sanitary items.

              It is self-evident that feeding so many hungry people each week is a huge challenge. Furthermore, it is most likely that the number of people who depend on these donations will be rising. Besides their food donations, Ibiza Food Bank adds a 10€ voucher to the food pack to be spent in Spars supermarkets, which are located all around the island, making it easy for everybody to buy in a supermarket close to them. Furthermore, Ibiza Food Bank started a GoFundMe, where everybody can donate money easily, which is being used to top up the food parcels.


              Camino de Santiago for Uganda Orphans

              Another cause, for which we decided to raise awareness and donate money to is Peacharoo Peachey’s charity. Peacharoo is a good friend of one of our sales agents at Prestige, who started the Camino de Santiago from Valencia by himself in October to raise funds for Ugandan Orphans in rural Kabale. To finance the Camino, he sold all his belongings, as he sees this opportunity as a personal challenge and a possibility to help these kids.

              Together with the local project BHHNP, his goal is to raise 70,000€ to buy land with school structures and to pay for the education of 163 orphans. All these kids have lost their parents to diseases. Some of them live with their relatives, others live in the wild, but all of them need food, love, and education. The local project’s objectives are to help the needy people and orphans in their community. It provides educational and medical services, to reduce the number of street kids and people in need. Currently, they are providing food, clothes, personal hygiene articles, and medical services.

It is paramount we see the island as a whole and with equal opportunities for all, and where there are inequality and need, we desire to stand together to make a difference and create long-lasting improvements for the health and well-being of our local community.                 2021 Annual Ibiza Property Market Report and 2022 Forecast

                Based on both internal and external sources, this report presents information on the property market in Ibiza and the Balearic Islands for the year 2021, as well as its projected forecast for 2022. Based on data and figures received in 2020 and 2021, the analysis covers four main topics of discussion:

                1. The General Balearic Property Price Curve & Sales 
                2. The Ibiza Property Price Curve 2021 Summary
                3. The Ibiza Luxury Housing Market Report 2021 with Prestige Properties
                4. The Forecast for 2022 


                1. The General Balearic Property Price Curve and Sales

                Over the past decade, as discussed in our year-end property market review for 2020, both sales and house prices have shown continual and stable growth across the Balearic Islands. Here we can see, although the real estate market took an abrupt decline following the Spanish financial Crisis in 2007, the market has since stabilized and experienced a steady recovery, reaching a peak increase for both sales and price by 2017.  


                The first marked fall in prices and sales only occurred in late 2019 through until 2020, suggesting that the market as a whole was experiencing minor stagnation.  This minor stagnation was only exacerbated by the fact that the property market industry, like many other sectors, started to experience less movement due to the uncertain status of COVID-19 as well as three months of physical inactivity due to complete closure. 

                However, as early as the summer of 2020 and moving through until the end of 2021 we have been very pleased to see buyers’ activity quickly restart, and thriving again with property sales continuing to rise in all sectors of real estate across the Baleares. 


                There should be no doubt, however, that this growth has been influenced not just by the characteristics of the local market, but also by global interest in real estate as a whole.  

                According to Forbes, 2021, "In the wake of the lockdowns in March, Americans discovered that existing homes were not adequate for the new work, teach, exercise, cook and live at home reality. Based on realtor.com surveys of consumers, we learned that home shoppers are looking for more space, quieter neighborhoods, home offices, newer kitchens, and access to the outdoors, traits which have revived a strong interest in the suburbs and smaller metro areas." 

                This is further supported by Savills Global Real Estate Service who claim our changing priorities since Covid-19 are shifting global residential real estate. Here the international agents describe, "tastes shifted during the pandemic as home became the centre of the universe… We have (also) seen a step-change in second home ownership too. In Dubai, 2021 has seen an ‘unprecedented influx’ of international high net worth buyers looking for a second home and as Hugo Thistlethwayte, Head of Global Residential Operations, notes: ‘There has been a realisation that a second home doesn’t need to be an hour from the main city residence, but could be in Aspen, Jackson Hole or Switzerland. This trend could make places like the Algarve, Mallorca and the south of France 52-weeks-a-year locations." (2021)

                As we can see from the Balearic year-on-year variation in house prices (below), despite a temporary pause in buying activity, the interest in moving location, and seeking a new property has not only since recovered, but has quickly regained the highest pricing since 2007, supporting the argument that living priorities and significant interest in real estate have increased as a result of the pandemic.


                2. The Ibiza Property Price Curve 2021

                There is no doubt that the pandemic has altered our notion of home, finally allowing us to dare to create our dream life, working a city position amid a coastal or countryside second-home alternative, and, of course, complemented by the chance to also secure a strong investment.

                Here in Ibiza, it is evident that we are experiencing similar "unprecedented influxes" and a small boom in the luxury sector of Ibiza’s real estate market for second-home international buyers, brought on by Covid-19. The pandemic has motivated buyers with means to invest in properties located in safe and more natural surroundings, away from overcrowded so-called ‘hotspots". Ibiza’s high-end and upscale property market, therefore, continues to be a desirable location for second-home buyers particularly from Europe, and naturally, we continue to experience a situation of low supply versus high demand, which means that many villas and properties are seen as rare products, driving price booms, resulting in a strong and an unwavering price curve right here in Ibiza (see section ii price per square metre comparison below). 

                While prices and sales lowered during autumn 2019 and early 2020 in the Baleares as a whole (as seen from the graph above), it must be noted that Ibiza’s luxury real estate market has often shown to be more resilient than its neighbouring islands, and set-backs or downturns in the market and price curves never hit quite as strongly.


                3. The Ibiza Luxury Housing Market Report 2021 with Prestige Properties

                All data discussed below is a representation of our internal data related to the Luxury Housing Market in Ibiza and is solely taken from our internal database.


                i) Average Price per Square Meter

                Our internal statistics from our sales database with Prestige Properties Ibiza calculated an average increase in price per square metre, from 6.569 to 7.927€, approximately a 21% increase between 2019 and 2021.


                ii) Average Price & Price per m2 by Municipality

                On the whole, all areas on the island have experienced price-per-square-metre increases between 2019 and 2021.  

                N.B The price per square meter, per municipality, may need to be flexible as the figures depend solely on our internal sales, and weighty factors may apply, as noted in our analysis hereafter.

                Eivissa – Average Price & Price per m2 by %

                The entire city is in high demand and continues to demonstrate a strong market presence. Overall, Eivissa has something for everyone, like most cities in Europe, and has increased in popularity in line with the rest of the island. Eivissa has experienced a 15% increase in price per square metre since 2019.

                Sant Josep – Average Price & Price per m2 by %

                San José has always been high in demand among affluent luxury second-home buyers.  In 2021, if we segmented San José, areas such as Es Cubells and Ses Salines would still naturally appear at the very top of the island property portfolio, where many other San José developments and properties would now be on par with some of the properties and prices on offer in Santa Eulalia. Sant Josep has experienced an 18% increase in price per square metre since 2019.

                Santa Eulalia – Average Price & Price per m2 by %

                In 2021, a particularly large property sale occurred in Santa Eulalia, leading to an unusual rise in the overall average price per square metre and as previously mentioned, some flexibility is required here. However, if we take the current average as gospel, Santa Eulalia would have experienced a 48% increase in price per square metre since 2019. It is clear that Santa Eulalia (despite margin for slight error) is catching up rapidly to the highly sought-after area of San José.

                Sant Antoni – Average Price & Price per m2 by %

                The area of San Antonio de Portmany is slowly making progress, becoming more sought-after than clients may first assume. Although the area is often in less demand than other areas, potential home buyers are often encouraged to look at the abundance of opportunities and great investment prospects here.  San Antonio has seen a 12% increase in price per square metre since 2019.

                San Juan – Average Price & Price per m2 by %

                In the last couple of years, Sant Joan seems to be where the most prestigious and expensive villas are located, with a price tag that has almost doubled on average over the past few years. The new demand for properties in the municipality is a reflection of the property market’s high-end price valuation. San Juan has seen a 6% increase in price per square metre since 2019.

                According to Tinsa (2021) Living on the Coast Report, the market in Ibiza has exhibited different behavior depending on the segment. However, as per our internal analysis, the demand for detached homes for sale or long-term rental has increased. There have also been price increases, more notable in detached homes than in new developments.  They summarised:  

                Standard multi-family homes sit between 3,000 and 4,000 €/m2, with a surface area from 50 m2 to 140 m2, with one to three bedrooms. Single-family homes typically register between 6,000 and 7,000 €/m2 and those larger family homes value between €10,000 and €20,000/m2. These properties were mostly located on the seafront promenade of Ibiza or on the front line of a marina. The most expensive single-family home registered between 12,000 and 15,000 €/m2 for a detached house. This product was mostly located on the west coast of the island of Ibiza in the municipality of Sant Josep and around Ibiza in the neighbouring municipality of Santa Eulalia.

                iii) Sales per Year

                Our internal statistics from our sales database with Prestige Properties Ibiza between 2019 and 2021 calculated a very minor decrease of 4% in sales and only 3.5% in volume, which despite the 3-month closure of offices and ability to partake in property viewings is basically a non-existent comparison.

                Properties sold to date in 2021 (up until October 2021) have calculated an increase of 56% more sales than 2019 and a turnover of 95% increase in Euros related to direct sales.

                iv) Enquiries per Year

                Even with pandemic news, lockdowns, and restricted movement, we still saw an ongoing and steady flow of users visiting the website and generating inquiries throughout the year 2020. During the year 2021, since restrictions began to ease, an increase of over 36% has been recorded as active inquiries conducted by individuals seeking an Ibiza property whether through sales or rentals.

                Conclusion: The Luxury Real Estate Market Ibiza 2021

                Even with the pandemic looming during 2020, luxury housing in Ibiza continued to make progress regardless. As we can see from the information and data above, the way we are changing and prioritising our home lifestyle has led to a definite increase in global (and island-wide) interest which has only resulted in a growing buyers market in 2021. As more and more clients seek out their ideal lifestyle in a more relaxed environment, away from the hassles of the big cities, it is evident that international buyers continue to dominate and strengthen the luxury real estate purchasing market.  In fact, "user behavior data shows Ibiza remains the most popular among the three main Balearic islands, achieving 22% more listing views than Mallorca (even though it has half the number of active listings)." – James Edition, October 2021

                4. The Forecast for 2022

                It is expected that house prices will continue to rise steadily and consistently in the luxury property market in Ibiza as there are no signs of crisis at present, making for attractive investment opportunities. In general, this speaks of Ibiza’s upscale market, which not only survived but flourished during the pandemic, giving us confidence that the island will continue to be attractive on an international level for the foreseeable future 2022. However, we do not envision a continuation in the number of sales we have witnessed during 2021.  We anticipate the sales boom of 2021 will potentially slow down as the post-pandemic effect fades away, especially as we are increasingly seeing a case of low numbers of sellers in the market as we continue towards the end of 2021.

                Long-term rentals for larger properties have become increasingly popular, especially with families. Prestige Properties Ibiza was required to hire more staff by the summer of 2021 in order to deal with the influx of inquiries, especially for long-term rentals. This is also confirmed by Morna International School, which has received a record number of new student applicants, who are also seeking residency (James Edition, 2021), indicating a potential anticipated interest for families in 2022 who may be keen to stay in the rental market until the right property for sale arrives in the future, or on the opposite side of the coin, they may return back to the metropoles once the effects of the pandemic and lockdowns are both a distant memory, (which at the moment, seems like is not likely to happen anytime soon). Either way, it is still undeniably the international buyers and overseas investors who are still the main market for second luxury homes in Ibiza and are expected to be in 2022.

                Additionally, the island is exhibiting even greater growth in general, becoming an even more desirable and trendy place to live. Since small, local businesses have struggled to cope with lockdowns and business closures, we have also seen an influx of new, innovative bars and restaurants opening, and signs that continued investment is underway.
