The list of frequently asked questions we receive from our clients who want to invest in a property in Ibiza is endless! So, we thought we would write this short article to provide you, as a UK citizen, with everything you need to know about buying a property in Ibiza, post-Brexit.

Can I buy a property in Ibiza after Brexit?

Yes, most definitely! Additionally, the Spanish government actively encourages international buyers, including British citizens, to invest in Spain. Having said that, there have been some changes to expat rights since Brexit. But, these changes have not seemingly impacted international property purchasing in Spain – especially for second-home buyers.

When it comes to purchasing a property in Spain, the Balearics, and Ibiza, very little has changed. The difference now is dependent on the legalities surrounding living in Spain or visiting it as a non-EU resident. While there are regulations and limitations currently applicable to British citizens, there are also alternative solutions that can be found. And, should you ever wish to relocate permanently, there are routes for you to become a full-time resident – which will be discussed further on.

Is Ibiza’s property market still strong after Brexit?

Absolutely! In recent years, Ibiza has become a very desirable investment opportunity, especially among second-home buyers and those wishing to relocate on a more permanent basis. In fact, Ibiza’s influx of property buyers over the past 2 years, which can be well-attributed to the global pandemic, saw buyer activity jump into overdrive. Property sales and prices since have continued to rise with strong demand among buyers and a shortage of sellers.

Ibiza in general is an excellent market, thanks to its stability and safety, especially for long-term investments and ongoing property value increases. What taxes and costs apply when purchasing a property in Ibiza after Brexit?

Your property price will not be affected by your nationality or citizenship, and you will not be required to pay any additional fees. Whatever your citizenship, you will pay the same amount as everyone else. There are, however, some differences between buying property in Spain and the UK. In the UK, you exchange the property contracts, pay the vendor, and the property is yours. After that, you register the property in the land register.

In Spain, you will need to be aware, whether you are a resident or non-resident, of the property taxes related to any purchase, sale, or ownership of a property. Additionally, a notary will also be required to witness the process and add your title to the property’s register. Fees paid to the notary are controlled by the Spanish government which can vary significantly depending on the number of clauses, deeds, and value of the property itself.

Typically, the costs involved in purchasing a property include the following:

Purchase tax
The Notary’s fee
The property registry fee
Some small miscellaneous expenses

Will I have any problems visiting my property in Ibiza post Brexit?

As we all know, travelling between the UK and EU after Brexit will not be as straightforward as before. And if you intend to spend a significant amount of time each year in your second home in Ibiza, you will need to be aware of the limitations. These limit stays apply to the whole of the EU but allows you to move freely without border control within the Schengen Area. Generally speaking, short stay limitations for UK visitors are the same as pre-Brexit and all other non-EU citizens.

The 90/180-day short stay rule

You can arrive in Spain and freely cross into any of the 26 countries that make up the Schengen Area without border control. The Schengen Area includes; Austria, Belgium, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland. However, a maximum stay of 90 days total applies within the 180 day period.

So, for example, if you arrive in your Ibiza holiday home on May 1st, you can live there full-time until the end of July (a total of 90 days), or you can hop around and travel in and out of the Schengen Area within this timeframe. After that, you must leave and not return to Spain, or any other Schengen Area again until the start of November (a total of 180 days).

Therefore, in terms of short stays of a month or two, weekend breaks, and two-week holidays, entry rules haven’t changed since Brexit. Here is a handy Short-Stay Visa Calculator to help you stay within the 90/180-day rules.

Can I live long-term in my property or become a permanent resident of Ibiza?

Although rules may apply, there are ways to extend your stay legally. The Spanish government makes every effort to encourage non-EU residents to purchase a property here. Therefore, even with the 90/180 short stay EU rules, the Spanish government is constantly evaluating and optimising longer stay possibilities through visas.

Spain offers several visas allowing longer stays. Two of the most common visas are the Non-Lucrative Visa and the Golden Visa. The Non-Lucrative Visa allows stays longer than three months for retirees who do not wish to take up employment in Spain. Applicants must show a bank balance of €34,000 for at least six months and a valid private healthcare plan. The visa is valid for one year and can be renewed for two more years thereafter.

Investors who have spent at least €500,000 on the property are eligible for the Golden Visa. A family application costs around €5,000 and lasts for two years. The Golden Visa allows holders and their families to live in Spain. For this visa to be renewed, you do not need to live in Spain, however, if you do live there, you can become a permanent resident after five years and a Spanish citizen after ten years.

What are my options for renting out my property for tourism?

It will be fine for you to rent your property for tourism purposes post-Brexit, but there are a few things to consider. As a Spanish or EU citizen, the rental income tax is 19%. However, for non-EU citizens, the rental income tax is higher and is currently set at 24%. Secondly, buying a villa for rental purposes is popular in Ibiza. It is, however, not an easy process. Not every property on the island can be rented to tourists. Obtaining a final tourist license and filling out the application require strict criteria and requirements to proceed.

Buying a Property in Ibiza with a Touristic Rental License

In Ibiza, there are many people who wish to buy a villa to rent out for tourism purposes. Despite this, it is not as simple as many would believe. Not every property in Ibiza can legally be rented out to tourists for short-term holidays. Those who wish to proceed with renting their property will need a final tourist license. And, any application for a tourist license must satisfy a strong set of requirements. It is becoming more and more difficult to find older, authentic properties now in Ibiza that can be renovated and re-sold with good returns on investment. A few years back, this was a great option with many more properties readily available. Now, it is becoming harder to find this type of property with the potential to create a modern boutique-style home and gain a decent return. But, of course, it is still possible if you employ the support and expertise of a good estate agent who knows the market well and can advise the right construction teams to employ for such projects.

Buying a Property in Ibiza during ‘off-plan’ or during the ‘project phase’

There is also the option of purchasing a property off-plan or when the project is still in the development phase, where you then would continue to build the home yourself. If you have time, patience, and passion on your side, there is a good chance that you can save quite a bit of money too, making for a great investment opportunity. Further, this kind of property can also be resold with a bit of a profit margin, or leased on a long-term basis, excluding short-term holiday rentals. As we previously mentioned, obtaining a tourism license encounters a strong set of requirements, and new build properties must wait 5 years before they can apply for tourist rental licenses, and it can still prove challenging even after that.

Living in Ibiza: Life in San José (Sant Josep de sa Talaia)

San José (Sant Josep de sa Talaia), located in the west of Ibiza, is renowned for its incredibly authentic and tranquil repose. Anyone looking for a prime location to buy a property, or embark on a short-term tourist visit, will be pleasantly surprised at this unique Ibicencan village.

Sant Josep (as it is called in Catalan) offers spectacular surroundings, plenty of traditional charm, a local community and family-friendly atmosphere, with vast mountain landscape views, direct access to Ibiza Town, and quick accessibility to many of the encompassing beaches of the municipality, such the renowned hotspots like Cala Jondal, Sa Caleta, Cala Molí and Cala Tarida.

The traditional village is known as the ‘capital’ of the Sant Josep de Sa Talaia municipality, which sits perfectly at the foot of Sa Talaia, the island’s highest mountain, measuring 475 meters high. The beautiful main street and adjacent cobbled alleyways are complete with a central white church, a wealth of desirable restaurants, bars and cafés, a handful of boutiques, and a local craft market held each week throughout the entire year.

Although the area has become a high attraction to many new visitors and international clients, San José village is still very much a traditional corner of Ibiza, which is perfectly knitted together with old and new.

San José (Sant Josep de sa Talaia): The Church

Every village and town in Ibiza is marked with a traditional parish church at the centre, however, the San José Church is somewhat unique when compared to other villages. The whitewashed building is of an exceptional height with a façade next to the belfry bell tower, a wide portico, a sundial, three frontal arches, and a large separate entrance to the rectory.

The church is a regular tourist attraction for those cultured visitors on the island due to its magnificent interior design and artworks. Although many of the original works of art were damaged during the Spanish civil war in 1936, restoration took place in the late 18th century, making San José Church an incredibly beautiful and interesting visit.

The church of Sant Josep is still very central to the local townspeople with regular faith gatherings and early morning ringing of the bells throughout the village, where the monumental landmark stands as a proud symbol watching over the local Ibicencan community here.

San José (Sant Josep de sa Talaia): The Culture

San José village has gracefully held on to much of its original community spirit and historical architecture and is one of the few places left on the island where time seems to have stood still. The area is notable for locals regularly scattered, sitting on café terraces, hosting daily ‘meet and greets’ as part of everyday life under the shade of the village trees. San José is widely recognised as a village where locals outnumber tourists most of the year.

However, during the height of the season, Sant Josep also has a very inviting ambience and a casual yet vibrant evening life that openly welcomes tourism into its quaint traditional setting, which is perfect for indulging in some great gastronomic eateries and enjoying some fantastic live music.

There are several supermarkets, a fishmonger, a butcher, two patisseries, various banks and a pharmacy, as well as plenty of smaller independent shops and boutiques to browse around during your San José visit, including many handmade ceramics stores, local fashion, home decor and artisan souvenir shops.

For such a traditional town, Sant Josep also offers a bounty of choices for gastronomy, from up-market eateries to pizzerias and local bars where you’ll appreciate extraordinary cocktails and live music. Look out for Raco Verd Ibiza serving healthy breakfasts through to afternoons and evenings of Spanish tapas and homemade Mexican cuisine. The beautiful bar and restaurant are set in a picturesque finca farmhouse garden, offering regular live music from both local and visiting artists, from Acoustic Rock, Jazz, Blues, and Bossa Nova through to authentic Flamenco Dance Shows.

Although not directly in the town itself, Can Domingo also comes highly recommended. A garden filled with the scent of wildflowers and tables nestled amongst the canopy of mature olive and fruit trees. Can Domingo is a pleasant dining experience with a menu presenting true Italian contemporary fine dining with a touch of tradition, reflecting the abundance of high-quality local produce and the providence of the Can Domingo organic garden.

Destino is located in the center of the village with a large outdoor terrace, directly in front of the church. Its cuisine is based on small tapas bites and an original menu, that come highly recommended among the local crowds. The owner, Claudio Radke, is of German and Moroccan origin, which translates into a varied, authentic and tasty cuisine.

Restaurant Es Galliner offers a typical Ibizan menu with plenty of Spanish classic dishes. The cozy, yet no-frills family-run restaurant has been open for over 14 years and still uses Mama’s secret recipes for their desserts, including their well-known Ibizan Mint Cheesecake (the flaó). With great reviews on Tripadvisor and a popular hang-out among locals, Es Galliner is one of the most frequented restaurants in the village. From morning breakfast through until lunch and dinner, the restaurant hosts an incredibly reasonably priced menu and a wide variety of plates to choose from.

Can Jeroni Cultural Centre is the main cultural centre located close to the village town hall. Here the local community and visitors alike can enjoy a trip to the town cinema and enjoy the regular shows and numerous cultural activities on offer throughout the year. San José offers an inviting and atmospheric weekly market, held every Saturday, throughout the entire year promoting the local artisan and ecological products of the island.

The ‘market-meeting-place’ overspills onto the streets and offers a wide variety of local farmers’ produce, street food, handcrafted artisan gifts including traditional wicker baskets, jewelry, local organic baked goods, leather goods, children’s soft toys, typical bohemian fashion, and plenty of local art.

San José Fiesta

Each town celebrates its own patron saint day with festivities and celebrations to mark the occasion. Usually set across an entire week, a program of cultural, gastronomic and musical events is organised through different associations and the local City Council. Every year around the 19th of March, Sant Josep hosts their patron day. A spectacular festival consisting of music concerts, a Flower Power party in the church square and plenty of traditional folklore performances. There’s always plenty of markets, food stalls, children’s entertainment and regular family activities to get involved in.

History of Ibiza Tourism

San Mateo

We may still be in the latter part of season 2020, but with many travel plans postponed, cancellations of flights and numerous ongoing global travel restrictions; we think it safe to say that many of us are ready to put our disappointments for the year 2020 behind us and start looking forward to a brighter horizon – and this includes our desire to travel and enjoy our usual summer vacations again in the near future!

Despite a very unexpected turn around for the tourism industry here in Ibiza over the past few months, we believe, Ibiza 2021 is going to see a positive season and an influx of tourism.

So, what gives us this strong sense of expectation?

Planning Ahead Summer 2021

Whilst next year may seem far off, planning travel in advance for 2021 may be more necessary than before. In recent years, with the speed of the internet and booking systems, tourism in Ibiza has demonstrated many last minute bookings for various weeks throughout the season. The occurrence of pre-planning and securing dream vacations in advance mostly consisted of longer stays for up to or over a month, when considering larger group vacations, first choice luxury villas, events, and those extra popular summer months like August. However, now, in the light of recent circumstances, we are seeing even more forward travel planning than usual.

We have noted that many ‘postponed 2020 travel plans’ have already selected dates directly into the 2021 calendar, which inevitably means the annual holiday diary has already started to fill up at a much faster rate than previous years.

This additionally must take into consideration the many extra travel dates moved for weddings and events, that were also due to take place during the 2020 season.

Aside from these ‘change of date’ bookings, whether vacation or event, we have also noted a recent increase of travel enquiries for Ibiza 2021, which is usually a rarer occurrence during the height of summer.

In fact, "drawing on Google data, a study was revealed by travel company Kuoni, who mapped the most searched for and most popular 2021 holiday destinations for 131 countries around the world. The study showed a clear demand for future travel, with Google Trends indicating that searches for "2021 holiday" increased by 124% when compared to the end of March". – Lonely Planet 2020.

So, it would appear now is the perfect and popular time to consider booking travel for next year!

Flexibility and Risk-Free Travel

The COVID-19 pandemic has taught all travellers one thing about the validation of travel insurance policies in such circumstances, whereby for the majority, epidemics and pandemics are not covered. Therefore, flexibility has become a key component for many hotels, travel agents and airline companies who are adapting to accommodate customers.

The overall essence for the travel industry is to offer (in the case of travel restrictions both current and future) risk free bookings and flexible date changes.

Many agents and hotels are also offering discounted rates for early 2021 bookings to help sustain the economy here. It is now more important than ever to fully understand the need to be flexible and be prepared to make changes where required.

Therefore, customers and travellers can feel reassured that there is no need to stop planning future travel, but just feel comfortable with flexible date options, and be able to adjust if necessary.

What to Expect from Ibiza 2021

Whilst we evidently cannot fully predict the future, it is clear that Ibiza has adapted to the current circumstances and is taking a positive attitude, where possible to continue business as usual.

The nightclubs have been most affected by safety measurements put in place and have been required to remain closed throughout 2020. However, despite this annual setback many have already begun to forward plan for Ibiza 2021.

Hi Ibiza has recently announced next year’s residency with 2021 declared to be their biggest summer to date, bringing world class DJs, state-of-the-art productions, and a promise to put the clubber at the centre of the experience. Additional to their returning residencies Afterlife, Black Coffee, F*** Me I’m Famous! and Glitterbox, new residents include The Martinez Brothers and FISHER to join the party.

We fully hope to see the Ibiza club scene return as usual in 2021. However, with or without the nightclubs open, Ibiza is a determined island which has demonstrated throughout 2020 its passion for tourism despite the circumstances.

Even without the world-famous nightclubs open, our island has hosted a fresh interest for culinary experience, sunset charters and private yachts, travel for natural beauty and relaxation, and adventuring those less travelled paths and discovering the islands hidden gems too!
With overcrowding at a minimum and roads traffic free, Ibiza has been a beautiful and rare experience that we should all take into consideration even if travel numbers need to stay lower and safety measures (like closure of the nightclubs) remain in place.

When planning for 2021, finding a destination that offers security and safety does include Ibiza, despite mainland Spain having steep surges of Covid-19 cases.
